Principal – John Swan, LLB
John has broad experience working with New Zealand businesses in all fields of business law, and is one of New Zealand’s best known and most experienced advertising and media law specialists.
He works with many of New Zealand’s leading advertising agencies and corporates, reviewing advertising and advising on advertising and marketing issues.
He is also Consultant Editor to ‘The New Zealand Guide to the Law for Sales and Marketing’, and a council member of the Employers and Manufacturers Association Central. A founding partner of successful Wellington law firm Gilbert Swan, John recommenced sole practice starting Swan Legal in April 2005.
“Sole practice has enabled me to concentrate my specialist skills in the advertising, marketing and intellectual property environment. Since the mid-1970s and the establishment of Colenso Communications Limited I have been involved in tendering advice to advertising agencies on legal issues arising from both broadcast and print advertising. Over the succeeding years I have assisted most of the major New Zealand advertising agencies in matters relating to the compliance of their work with legislation such as the Fair Trading Act, Privacy Act, Consumer Guarantees Act and gambling legislation as it affects sales promotion schemes.
In addition I have contributed to the development of a self-regulatory environment to maintain advertising standards in the internet environment by way of industry working parties promulgated by the Ministry of Consumer Affairs.
I have assisted clients as well as being involved directly in submissions made to Parliamentary Select Committees on advertising related issues, the most recent being the proposals to remove regulation of liquor advertising from the self-regulatory environment operated by the Advertising Standards Authority to the statutory environment created by the Broadcasting Act and maintained by the Broadcasting Standards Authority.
My work with advertising agencies has resulted in my advice being sought by major advertisers. This includes Telecom New Zealand Limited and Lion Breweries in their specialist areas and more recently Air Flow Products, a major supplier of pharmaceutical products to the New Zealand market.
I have maintained associations with industry bodies such as The Communication Agency of New Zealand (CAANZ) and the Association for New Zealand Advertisers (ANZA). I have provided seminars on legal compliance issues to CAANZ members and have contributed articles on relevant issues to various advertising related publications.
I am presently a board member of EMA Central, the industry body representing the interests of employers and manufacturers in the lower half of the North Island and a foundation member of the industry lobby group Business New Zealand.
In addition to the advertising related activity of my practice I provide commercial advice to a major provider of rest home and retirement facilities within New Zealand and in particular have been engaged on major acquisitions of rest home facilities in the New Zealand market over the last 10 years.
Arising from personal relationships developed from the commercial side of my practice I provide services to individuals in the trust and estate planning environment as well as personal conveyancing services to meet clients’ requirements in that regard.
